Native American Art & Authenticity Statement 

Bison Trail Development LLC is committed to the truthful and accurate representation of Native American art and products in accordance with the Indian Arts and Crafts Act of 1990 (IACA), as amended. 

Bison Trail Development serves as the business, production, marketing, and distribution company for original Native American artwork and related products created by qualifying Native American artists and artisans. 

Products specifically identified by Bison Trail Development as “Native American Made,” “Indian Made,” or as the work of a particular Tribe are represented as such only when the artistic or craft work qualifying the product for that designation has been performed by an enrolled member of a federally or officially state-recognized Indian Tribe or by an individual properly certified as an Indian artisan under applicable law. 

Artist Identification 

Unless otherwise stated on an individual product listing, original artwork marketed as Native American-made by Bison Trail Development should identify the individual artist and the artist's tribal affiliation.

Tribal Affiliation: Rosebud Sioux Tribe 

Produced and marketed by: Bison Trail Development LLC 

The artist may create contemporary, traditional, graphic, digital, printed, apparel-based, or other forms of artistic expression. Native American art is not limited to traditional forms, imagery, techniques, or materials. 

Production Disclosure 

Bison Trail Development distinguishes between the creation of original Native American artwork and the commercial production or reproduction of that artwork. 

Where the qualifying Native American artist personally performs the artistic or craft production necessary to create the finished product, the product may be identified as Native American-made when permitted under applicable law. 

Where original artwork created by a Native American artist is reproduced, printed, manufactured, assembled, or otherwise produced by persons who do not qualify as Indian artists or artisans under the Indian Arts and Crafts Act, Bison Trail Development will describe the product in a manner that accurately identifies the Native American origin of the artwork without falsely representing the entire finished product as Native American-made. 

For example, such products may be identified as: 

“Original artwork by Millard "Buster" Isennock III, Rosebud Sioux Tribe.” 

“Designed by Native American artist Millard "Buster" Isennock III, Rosebud Sioux Tribe.” 

“Featuring original Native American artwork created by Millard "Buster" Isennock III, Rosebud Sioux Tribe.” 

Business Ownership and Product Authenticity 

The Native American ownership or operation of Bison Trail Development is separate from the legal classification of an individual product under the Indian Arts and Crafts Act. 

A product is not represented as Native American-made solely because it is sold, marketed, printed, fulfilled, or distributed by Bison Trail Development. Product-specific representations are based upon the identity of the artist or artisan and the actual artistic and craft labor involved in producing the item. 

Commitment to Authenticity 

Bison Trail Development supports the protection of authentic Native American artists, Native-owned businesses, tribal identity, culture, and intellectual property. 

We are committed to providing consumers, retailers, wholesalers, and marketplace partners with accurate information concerning: 

• The identity of the artist or artisan
• Tribal affiliation
• The origin of the artwork
• The nature of the artistic contribution
• The method of production
• Whether an item is an original, reproduction, printed product, or commercially produced item 

Bison Trail Development does not knowingly represent artwork or products as being made by a particular Tribe unless the artist or artisan responsible for the qualifying work is an enrolled member of that Tribe or otherwise legally authorized to make that representation. 

This authenticity statement applies to products marketed directly by Bison Trail Development and through third-party retail and e-commerce platforms, including marketplace and wholesale partners.
